KCPS Data Protection and Privacy Policy

  1. Introduction
    1. KUCHING CITY PARKING SYSTEMS SDN. BHD. (Company No. 645934-K) (“KCPS” or “we” or “our” or “us”) recognises and undertakes its statutory responsibilities under the Personal Data Protection Act 2010 (“PDPA"), and acknowledge the importance of the personal data you have disclosed and entrusted to us, and that we are committed to manage, protect, process and disseminate your personal data properly and responsibly.
    2. Please read our Data Protection and Privacy Policy (“policy”). By providing your personal data to us, you hereby acknowledge and agree that you have fully read and understood this policy and are consenting to the collection, use, processing and disclosure of y our personal data as described herein. Failure to provide your personal data in a timely or accurate manner may result in us being unable to provide any or all of our services to you.
    3. Without prejudice to the foregoing, in the event any personal data of other third-party is provided by you to us, you warrant and agree that such third-party has fully read, understood and consented to this policy and your disclosure of his/her personal data to us for our use.

    1. Personal data and information collected from you, shall be used by us for website(s), website/IT portal(s)/mobile application(s), forms, surveys, and/or any other channels were required to facilitate the provision of our services to you.
    2. Personal data and information which shall be collected will include but are not limited to the following:-
      (a) your personal information (e.g. name, copy of your NRIC/Passport, date of birth, address, marital status, gender etc.);

      (b) your contact information (e.g. residental/work/postal address(es), email address(es), telephone numbers (home, office, mobile));

      (c) your billing and payment information (e.g.: details of your bank account(s), credit card(s) details, security code, expiry date etc.);

      (d) any other information or personal data, which we deem necessary.
    3. You warrant that all personal data and information provided to us are true and accurate, and undertake to inform us immediately if there is any change to the same. Any loss or damage caused by your provision of out-dated, or erroneous, inexact or incomplete information will be your sole responsibility and we shall not be liable.
  3. Purposes for which your personal data is collected and used
    1. We collect, use and process your personal data and information for any of the following purposes:-
      (a)To consider and process your application as our customer/user and to process your account with us;

      (b) To facilitate, process, deal with and/or administer your account with us;

      (c) For the supply of any goods or services which we may make available to you or which you may request or purchase from us;

      (d) To facilitate your use of the services at any of our website(s), website/IT, portal(s)/mobile application(s) and/or through other digital means;

      (e) For identification and verification purposes in connection with any and/or services supplied to you;

      (f) To carry out your instructions, requests, to respond to any enquiry from you, or to contact you by phone, text message, fax, and/or email;

      (g) To conduct analysis and development exercises (including but not limited to data analytics, surveys) to improve our product and services;

      (h) To carry out screening exercises (including credit, security and background checks) in accordance with our legal/regulatory obligations or our risk management policies which may be required by law or our internal system;

      (m) For storage, record, host, backup (e.g. disaster recovery or otherwise) of your personal data; and

      (n) And for any other lawful purposes which we deem necessary in provision of our products/services to you.

      (hereinafter collectively referred to as “Authorised Purposes”).
    2. You acknowledge and agree that we may need to disclose your personal data to any third-parties, including banks, payment service providers, our associate/affiliate companies, and/or other payment gateways, for any of the above Authorised Purposes.
    3. We may collect, use, disclose or process your personal data for other purposes not stated in the above Authorised Purposes. However you will be notified of such purposes, unless permitted by PDPA or the applicable laws or if relevant authorities permit or direct us to do so.
    4. You may withdraw your consent for the collection, use and/or disclosure of your personal data with us at any time. However, you acknowledge that the said withdrawal may result in the immediate cessation of our products/services to you. Please note however that your withdrawal of consent will not affect our ability to collect, use or disclose your personal data for specific purposes without your consent, if the PDPA or the applicable laws or if relevant authorities permit or direct us to do so.
  4. Our Promise
    1. The security of your personal data and information is important to us. We endeavour to take the necessary care and appropriate action to protect it from loss, misuse, unauthorised and accidental modification, access or disclosure, alteration or destruction. All information provided to us is stored in secure servers and payment transactions will be encrypted using SSL technology. While we try to guard your personal data the best we can, we cannot assure or warrant the safety of any data given to us, and do you so at your own risk. Where we have given you a password (or one created by you) which enables you to access our products/services (including our website(s) or website/IT portal(s)/mobile application(s)), you are ultimately responsible for keeping this password confidential, and we ask that you do not share it with anyone.
